This practice was abolished in the Russian Federation two years ago, the corresponding decision was made by the traffic police. However, now legislators want to use it again.
Car owners in the Russian Federation were previously punished for exceeding the average speed. To identify violators, the traffic police used data obtained from traffic cameras located in relatively small areas — for example, at the entrance to a small town and at the exit from it. The program, using a formula that includes the distance between points and the time spent on the road, calculated the average speed of the car. As a result, if the limit was exceeded, drivers received «letters of happiness».
However, this practice has always been very controversial: car owners often appealed against such fines, because there is no such term as “average speed” in the documents on the basis of which decisions are made. When the issue reached the Supreme Court of the Russian Federation, it was decided here that the long section of the road could not be called the place of the offense. As a result, in 2021, the traffic police stopped using this practice. At the same time, almost immediately, legislators started talking about the need to return it. The fact is that it allows you to collect fines from “reckless drivers” with a minimum number of expensive complexes for fixing traffic violations installed on the roads of the Russian Federation. According to Kommersant, the Ministry of Transport of the Russian Federation took into account the criticism and developed a draft of the amendments that need to be made to the traffic rules, and a set of relevant changes to the Code of Administrative Offenses is also being developed.
According to the draft amendments, a new term should appear in the Rules of the Road — “average vehicle speed”. The Ministry of Transport believes that it will denote «a value equal to the ratio of the length of the road section with the established speed limit for vehicles to the time spent by the vehicle to overcome this section.» In addition, the department proposes to change clause 10.1 of the SDA: according to the new edition, the driver will be required to drive a car both at an instantaneous speed not exceeding the “set limit” and at an average speed without violating the specified limits.
< p> In preparation for the return of the old practice, the Code of Administrative Offenses will also change: the code will regulate in detail the procedure for issuing fines for exceeding the average speed. In addition, you will need a decree of the government of the Russian Federation with the requirements prescribed in it for the installation of traffic cameras, including those that will record the average speed of cars.
According to Anton Kozlov, Deputy Director of the Department of State Policy in the Field of Roads of the Ministry of Transport, if the amendments are approved by the place of the offense (exceeding the average speed) the control zone of the last camera from all devices participating in fixing on the road section will be considered. At the same time, if the complex registers simultaneously exceeding both the instantaneous and the average speed, it is assumed that the fine will be issued for only one violation.
According to the Ministry of Internal Affairs, at the beginning of this year there are more 23.8 thousand stationary complexes for fixing traffic violations and about 3.2 thousand mobile cameras. It is known that during 2022, with their help, more than 150 million «letters of happiness» were sent to car owners demanding to pay a fine for speeding. At the same time, the vast majority of them (95%) account for exceeding the limit by 20-40 km/h. By the way, in the current year, this violation is still the most common.
