A California jogger allegedly filmed himself killing a homeless man who was blocking the sidewalk, according to prosecutors. against him.
Craig Sumner Elliott, 68, was jogging with his two dogs and pushing a cart on Sept. 28 when he came across 40-year-old Antonio Garcia Avalos, who was sleeping in the middle of the sidewalk, said prosecutors in Orange County, California.
Elliott allegedly tried to wake Avalos up by pushing him with a cart, at which point Avalos began yelling at Elliott to leave him alone.
Elliott , who allegedly filmed their encounter, then pulled a gun from his cart, prosecutors charged, adding that when Avalos stood up and threw a shoe at Elliott, he ducked and responded by shooting Avalos three times.
Avalos subsequently died from his injuries. Elliott, who has a valid concealed carry permit issued by the local sheriff, was arrested in the incident on November 17.
He faces manslaughter and felony charges. enhancements to the use of personal firearms in connection with the fatal shooting, prosecutors announced Monday.
«This is a tragic set of circumstances that took a turn for the worse due to the minor inconvenience caused by a blocked sidewalk, resulting in the death of a person,” Orange County District Attorney Todd Spitzer said in a press release.

Elliot was released on $100,000 bail. If convicted of all charges, he faces up to 21 years of imprisonment.
