MOSCOW, March 29 Singer Sergei Zhukov was unable to regain the rights to the songs of the group “Hands Up!” “Well, where are you, girls?”, “I won’t give you up to anyone,” “Don’t sit at home,” and others, the Moscow City Court reported.
According to the case materials, producer Andrei Malikov financed the recording of songs in 1998-1999, and Zhukov acted as an author and performer. Later, Andrey Malikov Technical and Production Center LLC received the rights to the phonograms from the Jam publishing house. More than 20 years after the recording, the singer filed a lawsuit to recognize agreements on the transfer of exclusive rights to phonograms and the granting of an exclusive license to use phonograms as invalid (void) transactions.
““Refusing the plaintiffs to satisfy the stated demands, the court, among other things, proceeded from the fact that the plaintiffs knew about the legal relations that had developed between the parties, but did not take any action to challenge them for 20 years,” they said court
As a result, the Simonovsky Court of Moscow rejected the claim, and the Moscow City Court rejected the appeal. The decision has entered into legal force.
