The bill providing for the return of the old practice, which was decided to be abandoned several years ago, has completed the stage of public discussion.
In Russia, in the past decade, drivers in various regions were often punished for exceeding the so-called “average speed”. So far, there is no corresponding term in the Traffic Rules, but this will soon change: the Ministry of Transport of the Russian Federation at the beginning of last month prepared the corresponding amendments to the traffic rules and began drafting changes to the Code of Administrative Offenses.
As Autonews.ru reports, the future government resolution regarding fines for exceeding the average speed has already passed the stage of public discussions on the Federal Portal of Draft Regulatory Legal Acts. The document developed by the Ministry of Transport of the Russian Federation assumes that the concept of “average speed” will appear in the current traffic regulations on March 1, 2024, and later fines will appear for exceeding the indicator established in a certain area.
According to the project, average speed should be understood as “a value equal to the ratio of the length of a road section with an established speed limit for vehicles to the time spent by a vehicle to overcome this section.” It is planned to measure this indicator based on the readings of two traffic cameras and the time the driver spent moving between them. If the value exceeds the acceptable value specified in the program, the car owner will receive a “letter of happiness.”
Previously, drivers appealed such fines both due to the lack of a term in the traffic rules and because it was impossible to accurately determine the location of the offense: because of this, the practice was stopped in 2021. Now, it is proposed to consider the location of the installation of the last camera, with the help of which the excess of the average speed was detected, as a point of the offense (as a result, recording will be carried out at a specific point on the territory of a specific subject).
An important point that requires clarification remains the size of fines. So far, representatives of the department have not talked about how exactly they will punish violators. The publication, citing experts who participated in the discussion of the project, notes that the penalty will be the same as for exceeding the “instant” speed: 500 rubles for exceeding the limit by 20-40 km/h, from 1000 to 1500 rubles for exceeding the limit by 40-40 km/h. 60 km/h, etc.
It is known that now operators and developers of road systems for recording traffic violations are preparing to return to calculating the average speed of cars on the roads. According to the head of the Astralab company, Sergei Laskin, some of the already installed traffic cameras will have to be re-positioned, since in the areas where the average speed will be monitored there should be one entrance and exit, as well as a single speed limit along the entire length of the route.
According to the Ministry of Internal Affairs, at the beginning of this year there are more than 23.8 thousand stationary systems for recording traffic violations and about 3.2 thousand mobile cameras on the roads in the Russian Federation. During 2022, car owners received over 150 million decisions regarding failure to comply with the speed limit, of which 95% were for exceeding the speed limit by 20-40 km/h. This year, this violation remains the most common.
