An updated version of the «list» that has been in development over the past few years will come into effect in a few months, starting September 1st.
In order to punish drivers for identified shortcomings in the technical condition of cars, traffic police officers use a «list of malfunctions in which the operation of vehicles is prohibited.» In particular, article 12.5 of the Code of Administrative Offenses (CAO) refers to it. Now the government of the Russian Federation has approved a new version of this document.
The “list” lists various technical shortcomings and breakdowns, a new version of this list has been developed by the Ministry of Internal Affairs since 2020. Now the repeatedly rewritten document has been finally approved, it will enter into force on September 1, 2023.
Judging by the rules, which will come into force in the autumn, the ban on the use of studded tires is introduced for the period from June to August. Non-compliance is subject to a fine of 500 rubles. It is worth clarifying that the use of Velcro, that is, winter tires without studs, will not be punished. Also, according to the “refreshed” document, from December to February it will not be possible to use summer tires on passenger cars (category M1) and light commercial vehicles (N1). It is also known that drivers of trucks (N2, N3) and buses (M2, M3) in the absence of winter tires (with or without studs) are now required to carry snow chains.
It is curious that initially the choice of time intervals for the introduction of bans on the use of seasonal rubber will be up to the regional authorities (after all, different regions of the country are in different climatic and weather conditions). However, in the end, it was decided to abandon this idea: the periods of summer/winter are determined “calendarly”.
The developers of the updated version of the “list” left the requirements for the residual tread depth unchanged: for passenger cars, an indicator of at least 1.6 mm is set. It is known that inspectors must take measurements using «technical diagnostic tools» — calipers. According to Kommersant, now the department is purchasing equipment for the regions. If there is a wear indicator on the tire, the traffic police will be able to use it to check.
According to the new list of malfunctions, the use of light sources in headlights and lanterns is prohibited if their class does not correspond to the “prescribed in the operational documentation”. The penalty for violators is 500 rubles. This wording also includes cars with optics with non-standard gas discharge (xenon) and LED lamps. The list of violations also includes a non-functioning regular automatic headlight leveling.
The updated version of the document also involves the introduction of a ban on driving with non-working ABS system: the malfunction will be determined by the indicator on the dashboard. By the way, even now the traffic police detects malfunctions of the brakes (in accordance with part 2 of article 12.5 of the Code of Administrative Offenses). Sanctions — a fine of 500 rubles, as well as evacuation to a car impound.
According to traffic police statistics, last year there were 4 accidents in the presence of technical malfunctions and conditions under which the operation of the vehicle was prohibited. .6% of the total number of accidents (5.8 thousand such cases were recorded). The list of the most common violations includes: changes in the design of the car, inconsistent with the traffic police, installation of wheels of different sizes and tires with a different tread type on one axle, malfunction of external lighting devices, as well as excessive tinting.
