The Heritage Foundation has filed a legal complaint under freedom of information laws, arguing that information relating to the Duke's visa application is of «huge public interest.»
The initial request was denied by US Customs and Border Protection because the Duke did not «agree that his information be shared with the plaintiffs,» according to court documents.
The Department of Homeland Security said the disclosure of documents relevant to the case , is not in the public interest.
In his scandalous memoirs, the Duke wrote: “Of course, around this time I used cocaine. At someone's country house, while filming, I was offered a part, and since then I've done a few more.»
He also revealed that he took psychedelic mushrooms at actress Courtney's California home. Cox and hallucinations in her bathroom.
The think tank claims it would have had to answer questions when applying for a visa, including: «Have you ever been a drug addict or addict?» and whether he has ever violated any law relating to controlled substances.
Sources close to Duke indicated that he was truthful in his visa application, suggesting he disclosed his drug use .
Sam Dewey, Legal Counsel for The Legacy Foundation, said: “We view this as a very serious matter — why he was let in, no problem, given all we know that we have explained in detail, and others — No. not let in.
“The [US] government has taken the position that there is nothing to see here. We took the position that no, if you look at all the details of his hospitalization, you look at the drug laws, you look at the hospitalization laws, there is a really serious question as to whether he should have been hospitalized. .”
