A new package of changes has been prepared by the Ministry of Transport of the Russian Federation. It includes new terms, increased fines and the creation of another federal register.
In accordance with the next amendments prepared by legislators, the legal status of owners of electric scooters and other personal mobility devices will differ little from the status of car owners. The new norms assume, in particular, that citizens will have to register their SIM cards in a separate federal register.
As Kommersant reports, the Ministry of Transport of the Russian Federation sent draft amendments for approval to the federal executive authorities, which are aimed “at additional legal regulation of the development of SIM.” The implementation of the department's new proposals is planned for the period from 2023 to 2026.
One of the requirements of the Ministry of Transport involves tougher sanctions for SIM users who violate the rules. Thus, according to Articles 12.29 and 12.30 of the Administrative Code, the current maximum fine for violators is 1.5 thousand rubles. It is not yet known how much the fine should be increased. Note that for car owners (individuals) it can reach 30 thousand rubles.
Let us remind you that amendments to the traffic rules regulating the rights and obligations of SIM users came into force on March 1, 2023. New clauses of the traffic rules included the very concept of “personal mobility device”, and also prohibited their users from reaching speeds of more than 25 km/h and driving onto highways. Now the Ministry of Transport has prepared additions.
The department, in particular, insists on introducing into the traffic rules the term “a person using a SIM card for movement”, the concepts of “ahead of a pedestrian” and “overtaking a pedestrian” when driving on a personal mobility device. In addition, the document, according to the department, should specify the conditions under which these maneuvers are allowed to be performed.
The amendments also regulate the responsibilities of SIM owners in the event of participation in an accident, as well as their obligation to undergo an intoxication test and comply with traffic police requirements to stop. In addition, the document plans to establish a direct ban on driving a personal mobility device while intoxicated.
It is worth noting that today official statistics do not separately take into account road accidents involving SIM users (the traffic police do the calculations independently). The Ministry of Transport proposed collecting all relevant accidents in the Rosstat report. It is expected that, based on data on the characteristic injuries of victims, the Ministry of Health will be able to develop treatment and rehabilitation schemes for victims. Also on the list of proposals is the introduction of basic rules for using electric scooters into the school curriculum (the Ministry of Education will be responsible for this).
The Ministry of Transport has also decided on amendments to the laws “On the Organization of Road Traffic” and “On Road Safety”, according to which individuals and legal entities will have to enter “information about SIM” into a separate federal register. It is expected that it will function similarly to the state registration of vehicles in the traffic police; that is, entering an electric scooter into a special register (or changing the record of the owner) will become another government service.
In the future, it is planned to consolidate the requirements for the infrastructure for riding, for parking for personal mobility equipment, and for regions will develop plans to “create and integrate infrastructure for SIM into urban transport systems.”
