According to the initiative, reckless drivers on the roads could be punished either by a fine of up to 10 thousand rubles, or by deprivation of rights for a period up to a year.
The term “dangerous driving” was introduced into the Road Traffic Rules back in 2016. It was assumed that this would make it possible to punish reckless drivers who deliberately ignore the rules of behavior on the road: we are talking about such maneuvers as sharp braking in front of another car, playing checkers (sharp changes between lanes), failure to maintain a safe distance and lateral interval, and preventing overtaking and others.
It was expected that amendments would be made to the Code of the Russian Federation on Administrative Offences, according to which reckless drivers would be punished. In 2017, the corresponding draft amendments to the code were approved in the first reading, but later it stalled. As a result, punishment for such drivers still has not appeared in the Code of Administrative Offenses.
Representatives of the LDPR faction came up with another bill on this topic last summer. According to deputies, a new article needs to be introduced into the Code of Administrative Offenses — “Intentional dangerous driving.” The document assumed that the driver caught the first time would be fined 5 thousand rubles, and for a repeated violation (committed within one year) it was proposed to either charge up to 10 thousand rubles or temporarily deprive his driver’s license for up to one year.
Back in April 2023, the Duma Committee on State Construction considered that the term “dangerous driving” was too difficult to understand. It is assumed that this may lead to “its broad interpretation in the consideration of cases.” Based on this, the amendments to the Code of Administrative Offenses related to this traffic violation are rejected. However, the LDPR still introduced a new bill to eliminate the existing legal gap.
According to the head of the social policy committee Yaroslav Nilov, the initiators agree that the criteria for “dangerous driving” in the traffic rules are “vague”, so they propose to punish reckless motorists only if there is video evidence of the violation, and also solely by court decision. That is, traffic cameras will not automatically issue fines for “dangerous driving.”
However, as Kommersant reports, these conditions did not convince the State Duma of the Russian Federation of the need to amend the Administrative Code. A member of the Duma Committee on State Construction, Yuri Petrov (United Russia), stated that the new concept of changes is not supported. In their conclusion, the deputies noted that the term contains “an element of legal uncertainty.” They noted that first it is necessary to adjust its wording in the traffic rules, but no corresponding proposals have yet been received.
We would like to remind you that most fines for drivers are now issued automatically using complexes for recording traffic violations. Some of the devices are private: the owners receive a certain percentage of the collected fines. Recently it became known that the State Duma of the Russian Federation rejected a bill banning private cameras on Russian roads. The review stated that the amendments proposed by the initiators were “not sufficiently substantiated.”
