MOSCOW, August 2 Senators have approved a law requiring persons engaged in cryptocurrency mining and distribution to comply with anti-money laundering legislation.
The initial version of the document, when considered by the State Duma, obliged notaries to comply with anti-money laundering legislation in their work. During the second reading, the State Duma supported the amendments, which include digital currency miners (including mining pool participants), as well as the person organizing the activities of the mining pool, in the scope of regulation of the law on combating money laundering and terrorist financing.
They will be subject to requirements for identifying clients, assessing the level of risk of them committing suspicious financial transactions, taking measures to reduce it, etc. These requirements will apply to the mining of digital currency and its distribution, including among mining pool participants.
If a person organizing the activities of a mining pool has any reason to believe that the distributed digital currency may be used by pool participants to launder criminal proceeds or finance terrorism, he will be obliged to notify Rosfinmonitoring of this. A similar obligation applies to digital currency miners.
These persons will also be obliged to provide Rosfinmonitoring with information upon its requests. Moreover, they are prohibited from disclosing the fact of transferring such information to it.
The law, which also contains other changes, is to come into force 10 days after its official publication, with the exception of provisions for which a different period is established.
