He said the system didn't work quickly enough to process cases and remove people, adding that this happened under «successive Home Ministers over the years.»
«Honestly, the Home Office inefficient,” he said.
He said that “changing legal tests” doesn’t matter “unless you have enough people to conduct investigations.” .
Sir Bob revealed that he has a friend who is also an immigration tribunal judge in the south east of England «where the pressure is really there». The man was reportedly only asked to sit down five times last year.
«There wasn't enough work,» said Sir Bob. “And why was that? Because the Department of the Interior did not have cases ready to go to the tribunal.”
He said that more resources would need to be invested in the immigration system to solve the problem.
Sir Bob added that the government also needed to have «reasonable arrangements with France» and other European countries in order to accept returning migrants. He said that after the UK left the previous EU system, “we did nothing to fill the gap.”
He added: “In fact, this requires a softer approach to dealing with our European partners rather than a game of accusation.”
A Home Office spokesman said: «The unacceptable number of people risking their lives on these dangerous crossings is putting an unprecedented strain on our asylum system.»
«The government is taking immediate action to close the asylum backlog, doubling the number of asylum professionals to 2,500 and streamlining interviews and paperwork.
«We are also illegally detained and sent immediately to their country of origin or a safe third country so we can stop the boats.»
Elsewhere in the interview, Sir Bob said that Alex Chock, the new Attorney General, is looking to strike a balance with his civil servants following the departure of Dominic Raab following complaints of bullying.
«I was a minister at a much lower level for a while, and I really appreciated civil servants,» he said.
«There is nothing hugging people a little is wrong, but that doesn't mean you can't be demanding too.»
He said it's okay to be demanding in a way that «encourages them to do better.»
