    They want to return fines for exceeding the average speed: the draft changes to the traffic rules have been finalized

    According to the amendments, new regulations regarding motorists will come into force not at the beginning of the coming spring, but from September 1, 2024 ( if approved).

    In some regions of the Russian Federation in the past decade, drivers were punished for exceeding the so-called “average speed”. Later, in 2021, it was decided to stop this practice, because these fines were often disputed, and decisions were made in favor of motorists. However, the situation may change relatively soon: the Ministry of Transport previously prepared the amendments to the traffic regulations required for the return of the norms, and now there is a revised version of this project.

    As Kommersant reports, the Ministry of Transport of the Russian Federation is now preparing draft changes to the traffic rules regarding exceeding the average speed for interdepartmental approval. The new amendments assume that the rules will come into force not on March 1, 2024, but six months later – on September 1. It is known that the document will include both the term “average speed” and a ban on exceeding it. The revised version of the draft is posted on the website regulation.gov.ru.

    The average speed is planned to be calculated based on the time a motorist spends traveling between two or more traffic cameras located in a certain area. The Ministry of Transport proposes to supplement clause 10.1 of the traffic rules indicating the obligation of drivers to drive “at a speed not exceeding the established limit” with a clarifying phrase – “including average.”

    For exceeding the indicator calculated by the formula, fines will be imposed: the corresponding clauses are planned to be added to the Code of Administrative Offenses (CAO RF) later, representatives of the Ministry of Transport and the Ministry of Economy spoke about this (the department supported the proposed changes to the traffic rules). Now the corresponding amendments are already being developed.

    The Ministry of Economy noted that “the current point control of instantaneous speed does not allow to exclude offenses on long sections of roads.” The department added that as a result, drivers in the coverage area of ​​the cameras move according to the “braking-acceleration” principle in order to avoid fines for exceeding the instantaneous speed.

    Some regions of the Russian Federation also supported the return of fines for exceeding the average speed. The list includes Tatarstan, Dagestan, Moscow, Smolensk and Vologda regions, as well as Krasnodar Territory and Khabarovsk Territory. The Ministry of Transport also explained that because of the innovations, regions will not have to face additional expenses, but “separate software” will be required to record the average speed. According to estimates at the beginning of this year, there are approximately 24 thousand stationary cameras on Russian roads.

    In order to get rid of the legal gap, the Code of Administrative Offenses will stipulate that the place where the driver committed the offense (if the average speed is exceeded) the control zone of the last camera in the chain of participating devices will be considered. It is known that the corresponding additional requirements will be listed in the rules for the use of traffic cameras: the Ministry of Transport is already developing a project, details will become known later.
